依《勞基法》規定,勞工每工作7日至少有1日休假,且雇主只有遇天災等突發事件時,才
能要求勞工例假出勤,但有鑑於勞工休假常被雇主「取消」,勞動部擬修法規定,員工例
休上班除得領雙倍薪外,還需在7天內申請1天補休。新法預計2016年上路,屆時雇主未確
切執行,勞動部將開罰2至30萬。
勞動部認為,例假就是要讓勞工休息,不是「拿錢來抵」。雖然現行《勞基法》規定,例
假日遇重大事件,如颱風、重大傳染病時,雇主可在勞工同意的前提下要求出勤,但部分
雇主卻會刻意把「休假」的停休規定偷渡到例假,或以雙倍工資的方式,要求勞工例假出
勤。為了防止勞工過勞,勞動部在新修正的法規中擬定,雇主除了給加班費外,應在7日
內給予1天補休。
此版新修正的《勞基法》除規定例休上班須給「補修」外,還增訂了每周正常工時40小時
、單月加班不得逾60小時等規定,此外,勞動部還要求雇主提供「工資各項目計算明細」
,若未依照規定辦理,經檢舉可開罰2至30萬元。勞動部勞動條件及就業平等司長劉傳名
表示,去年12月30日已將縮短工時修法草案送至行政院,預計下會期完成立法。
雖然新擬定的《勞基法》將正常工時從每周42小時縮短為40小時,但單月加班時間卻從46
小時拉長至60小時,引發部分勞工不滿,「台灣勞工陣線協會」等勞工團體也於5日上午
前往勞動部抗議,除了主張落實每周40小時的正常工時外,還提出了提高加班費標準、廢
除責任制與落實特休假等要求,希望能有效降低台灣勞工年總工時。
